The court has filed a transcript [35] of the November 22 TRO hearing proceedings. It is a 54 page document, but well worth reading if you're interested in the initial arguments and the nature of the judge's questions.
During the proceedings, the attorneys and judge refer jocularly to a previous "unclean hands" case decided by this same judge. I believe they are referring to First Global Communications, Inc. v. Bond, et. al., 2006 WL 278566, the so-called "Sex Guide" case. (A word of warning: searching for information about this case on the internet is a risky business.)
The Sleekcraft test is an 8-factor test used by the Ninth Circuit to decide trademark infringement claims.
